Platform Terms of Service & Licensing

1. Escrow Architecture & Milestone Holds
All transactions conducted through BClark Art require 100% upfront securitization into platform escrow. Funds remain in neutral custody until Phase 1 sketch milestone approval is executed by the client. Full dispersal to the creator occurs upon delivery of final master files.
2. Milestone Review Gates & Scope Boundaries
Commissions follow locked milestone tranches:
- Phase 1 (Sketch & Composition): Includes up to 2 revisions to anatomy, pose, and layout. Client approval locks the structural composition.
- Phase 2 (Line Art & Flats): Minor color adjustments only.
- Phase 3 (Render & Polish): Minor lighting and detail polish only.
Major structural alterations requested after Phase 1 sign-off incur a mandatory 35% Major Revision Surcharge.
3. Intellectual Property & Statutory Copyright (17 U.S.C. § 101)
In accordance with United States federal copyright law, the creator inherently retains all original copyright to the artwork unless an explicit, written Work-for-Hire agreement is signed by both parties. Licensing tiers granted through BClark Art are strictly designated as Personal Use, Limited Commercial, Full Commercial, or Full Buyout as specified on the transaction invoice.
4. Prohibition of Generative AI Synthesis
All artists on the BClark Art roster warrant that their deliverables are 100% created by human hand without unauthorized generative AI scraping or image synthesis. Deliverables must support C2PA Content Credentials or layered source files to establish authenticity.
5. Chargeback Dispute Defense
Clients who initiate bad-faith payment chargebacks with financial institutions after receiving deliverables violate platform terms. BClark Art maintains certified timestamped delivery receipts and sketch approval logs to defend disputes, and will permanently suspend accounts initiating fraudulent claims.
